Commission Details

  • The first investment will be paid upfront, by the client as a retainer for the designer’s time and effort. The remainder will be paid by the client before the designer sends final deliverables.

  • The initial payment is non-refundable. This covers the designer’s time spent on concepts and preliminary drawings are all for naught- if the client decides to cancel before the design is finished. If the project is cancelled by the client, or if the client is unresponsive during the allotted time agreed upon, the retainer and designs will solely belong to the designer. The client forfeits their right to the design and retainer in any way.

  • Communication: How quickly a design is completed is dependent upon information and feedback by the client. The more information, and quicker the response from the client- the less time the designer will need to make changes, or better yet: not need to spend time on changes. If the client is unable to communicate during the agreed upon time, the design will be pushed back accordingly.

  • Although its unlikely, the designer maintains the right to deny or terminate a commission. The designer can deny a commission request for any reason before the project begins. If the retainer has been paid, the designer can terminate the commission at anytime throughout the process. If the designer does terminate the commission, the client will be refunded their retainer, and the design will still belong to the designer.

Artwork, Intellectual Property, & AI Usage

The client may only use the delivered artwork for the purposes and within the scope specifically outlined within whats agreed upon. The client may not sell, sublicense, redistribute, reproduce, modify, trace, alter, recreate or otherwise use the designer’s artwork, logos, illustrations, or creative assets outside the agreed-upon scope without the designer’s prior written permission.

The client may not upload, submit, or provide the designer’s artwork, logos, illustrations, or creative assets to ANY artificial intelligence (AI) or generative AI system/of the likeness, for the purpose of training, dataset inclusion, image generation, image-to-image generation, modification, recreation, tracing or creation of derivative works without the designer’s prior written consent.

The designer’s artwork may not be used as a prompt, reference image, training material, or input for AI-generated or AI-assisted artwork intended to replace, reproduce, imitate, or create a substantially similar version of the designer’s original work.

ANY unauthorized use, reproduction, modification, AI processing, distribution, or creation of derivative works from the designer’s artwork constitutes a breach of this agreement and may result in additional licensing fees, termination of usage rights, and/or pursuit of available legal remedies.

From this point forward, any violation of the restrictions or requirements stated above will constitute a material breach of the agreement. In the event of such a breach, the client’s deposit will be immediately forfeited and retained by the designer as liquidated damages to the extent permitted by applicable law. The designer will retain all ownership, intellectual property rights, licensing rights, and usage rights in and to the artwork, and any permission or license granted to the client may be immediately revoked. The designer also reserves the right to pursue any additional remedies, damages, fees, or other relief available under applicable law.

Any exceptions to this clause must be expressly approved by the designer in writing. This is for and in the best interest of the designer and the client.

By submitting a contact form/commission and/or submitting a payment of any form, the client agrees to the terms and conditions stated above.
